It is important to note that the professional technician or certifier, be it an architect or engineer, must be obliged to carry out, at a minimum, an inspection of the property to be sold or rented.

What constructions do not need it?

Generally, there are exceptions to the rule. In this type of certificate there are different constructions which do not require an energy efficiency certificate. Next, we will show you what they are:

  • Buildings and monuments that are officially protected as part of a declared environment.
  • Works or parts of these that are used only for religious activities or places of worship.
  • Temporary constructions that have a useful term equal to or less than two years.
  • Works or parts thereof that are isolated with a useful area of ​​less than fifty square meters.
  • Buildings that are acquired to carry out major reforms or, failing that, carry out demolitions.
  • Buildings or part of these where there are dwellings, in which the use is less than four months a year.

To this last point, it is up to us to add that it is exempt from this certificate if the time of use is limited. And, also, if its energy consumption is less than 25% of what could result during a year of use. However, this must be proven by means of a statement from the homeowner.

On the other hand, this certificate is mandatory for all those who wish to carry out a sale or purchase transaction or, failing that, to rent a particular property. Similarly, the property owner must hire the services of a technician or certifier and follow the steps explained above.

Fines for Selling or Renting without the Energy Certificate

This point is considered one of the most important in our article. Since, it is common that the sanctions or fines that may arise when wanting to rent or sell a property in Spain are unknown.

For this reason, we have dedicated a part of our report to explain when the authorities sanction or fine owners who sell or rent the property without possessing the corresponding energy certificate.

Now, all those citizens and property owners who take the liberty of selling or renting their property without having this type of certificate, must pay a fixed amount for the sanction or infraction, and this ranges between € 300, up to € 600.

These infractions or fines are established by Law – 8 from June 26, 2013. It sets these sanctions to all those who dare to breach the regulations corresponding to energy efficiency certification.

Also, these offenses are divided into three groups. Each one depends on the degree and type of infraction that was carried out by the owner. This ranges from not informing about the energy rating obtained, to selling the property without previously making the certificate, or falsifying it.

  • Minor offenses: These will have a fine with amounts ranging from € 300 to € 600.
  • Serious penalties: At this point, the amount to be canceled by the owner will be between € 601, up to € 1000.
  • Very serious offenses: Finally, the amount of money that the offender must pay will be between € 1,001, up to € 6,000.

What is the Energy Certificate for?

However, the main purpose of this certificate is to show information to the potential buyer or tenant of a particular property about the amount of energy that has been consumed in a specific period of time.
