8 minutos de lectura

The Energy Certificate, It is a very important document for all those citizens who wish to sell or rent a property. It shows the total energy consumption and CO2 emissions of the property.

That is why, in this article we explain: how you can obtain the energy certificate, which are the buildings that do not need it, the fines for selling or renting it without permission, its function, cost and validity, and we conclude with its definition.

How to Obtain the Energy Certificate?

It is very common that, to start obtaining any type of certificate, agencies and institutions require or require a series of specific documents. This certificate, being a legal document, is not exempt from these requirements.

But don’t worry, because we will show you authentic and verified information of all requirements and steps requested and demanded so that you can start the process and, finally, obtain the certificate.

  • There are several ways to apply for the energy efficiency certificate. Next, we will explain what they are:
    • One of the main and most common is to simply make the request for a certificate budget.
    • Also, you can compare the prices published by professionals between the different offers of this certificate.
    • On the other hand, you have the option of searching the map for professional technicians or, failing that, certifiers.
    • Finally, you can search directly in the directory of professionals.
  • Subsequently, you must negotiate the price of the energy efficiency certificate.
  • Then, you have to set the date for them to carry out the proper inspection of the property to be sold or rented.
  • Likewise, the architect or engineer must carry out the inspection and take the data from it.
  • He has to make the respective energy rating of the property and, briefly, prepare the energy efficiency certificate.
  • In another sense, you must make the payment of the fees to the professional in charge of the inspection and data collection.
  • You will get your energy efficiency certificate shortly.
  • Finally, you will have the assessment of the professional technician or, failing that, of the property certifier.
It is important to note that the professional technician or certifier, be it an architect or engineer, must be obliged to carry out, at a minimum, an inspection of the property to be sold or rented.

What constructions do not need it?

Generally, there are exceptions to the rule. In this type of certificate there are different constructions which do not require an energy efficiency certificate. Next, we will show you what they are:

  • Buildings and monuments that are officially protected as part of a declared environment.
  • Works or parts of these that are used only for religious activities or places of worship.
  • Temporary constructions that have a useful term equal to or less than two years.
  • Works or parts thereof that are isolated with a useful area of less than fifty square meters.
  • Buildings that are acquired to carry out major reforms or, failing that, carry out demolitions.
  • Buildings or part of these where there are dwellings, in which the use is less than four months a year.

To this last point, it is up to us to add that it is exempt from this certificate if the time of use is limited. And, also, if its energy consumption is less than 25% of what could result during a year of use. However, this must be proven by means of a statement from the homeowner.

On the other hand, this certificate is mandatory for all those who wish to carry out a sale or purchase transaction or, failing that, to rent a particular property. Similarly, the property owner must hire the services of a technician or certifier and follow the steps explained above.

Fines for Selling or Renting without the Energy Certificate

This point is considered one of the most important in our article. Since, it is common that the sanctions or fines that may arise when wanting to rent or sell a property in Spain are unknown.

For this reason, we have dedicated a part of our report to explain when the authorities sanction or fine owners who sell or rent the property without possessing the corresponding energy certificate.

Now, all those citizens and property owners who take the liberty of selling or renting their property without having this type of certificate, must pay a fixed amount for the sanction or infraction, and this ranges between € 300, up to € 600.

These infractions or fines are established by Law – 8 from June 26, 2013. It sets these sanctions to all those who dare to breach the regulations corresponding to energy efficiency certification.

Also, these offenses are divided into three groups. Each one depends on the degree and type of infraction that was carried out by the owner. This ranges from not informing about the energy rating obtained, to selling the property without previously making the certificate, or falsifying it.

  • Minor offenses: These will have a fine with amounts ranging from € 300 to € 600.
  • Serious penalties: At this point, the amount to be canceled by the owner will be between € 601, up to € 1000.
  • Very serious offenses: Finally, the amount of money that the offender must pay will be between € 1,001, up to € 6,000.

What is the Energy Certificate for?

It is convenient that you know the function and purpose of this certificate, since in many cases it is not usually given the importance it deserves. That is why, below, we will explain what this document is for.

However, the main purpose of this certificate is to show information to the potential buyer or tenant of a particular property about the amount of energy that has been consumed in a specific period of time. In this way, the individual will have the opportunity to decide whether to buy or rent one property or another.

In addition, with this certificate, any person who wishes to sell or rent their property has the option of making numerous efforts to make their property more energy efficient than other properties on the market. Thus, you can have a competitive advantage.

Cost and Validity of the Energy Certificate

This point is considered one of those that generates more doubts and uncertainty, since it is quite common that a specific cost or fee is required to carry out any type of procedure. Which is not usually a low or reasonable amount.

However, this particular certificate is fixed by the free supply and demand of energy efficiency certificates. For this reason, it is very common for there to be a lot of competition between technicians and certifiers regarding the price of the same.

Therefore, we advise that the best way to get a good price is by comparing the amount of the offers that they can offer or, failing that, you can request several quotes from certifiers or energy technicians.

You also have the benefit or advantage of receiving a diverse number of free, no-obligation estimates. And, in this way, you can evaluate what is the amount that is convenient for you to be able to start the application for the energy efficiency certificate.

Now, below we will show you a summary or list where you can decide the best way in which you can obtain a budget to obtain the energy efficiency certificate or, also known as an energy certificate:

  • The first option is making a request for quotes.
  • The second is by comparing the prices between the offers.
  • The third is to search the map for professional technicians or certifiers.
  • The fourth, and last, is looking directly in the directory of professionals.

What is it?

We are going to conclude by offering you a definition about this type of certificate in particular. Well, it is nothing more than a document or report that is made up of several pages. This means that it contains enough information about the property.

Likewise, the abundance of information that is reflected in this type of certificate includes: details about the orientation, situation, envelope, lighting, and, finally, the energy production system of the property to be sold or rented.

However, the first part of the certificate contains the general data of the property, to this are added the data of the technician or certifier in charge of carrying out the inspection and other specific tasks that we mentioned in previous points.

On the other hand, and as we named paragraphs above, this document consists of four annexes, where specific and detailed information will be broken down in each one. Below we will briefly explain what is reflected in each one:

  • First annex: here, all the thermal characteristics of the property are described.
  • Second annex: in this part, the energy rating of the property is reflected, in terms of energy demand and consumption.
  • Third annex: here, everything related to the recommendations to improve the property is broken down.
  • Fourth annex: finally, the technician or certifier is in charge of describing the tests, checks and inspections carried out during the process.
