Filling of the Property Tax Declaration Form

To fill out this form, it is necessary to complete six (6) sections, which refer to the data of the affidavit for property tax.

Taxpayer data:

In the first section, the identification data of the taxpayer is entered, where the taxpayer code, the type of person (natural or legal), the type and number of national identity document, the date of birth and the names are indicated, surname or company name.

Likewise, the contact information, such as a fixed or mobile telephone number and the e-mail address of the taxpayer, are placed. Next, the spouse’s data is requested, such as: type and number of national identity document, date of birth, names and surnames and the reference telephone number. Finally, in this section the data of the address are placed, indicating the district, block, department, description of the urbanism and the reference points to locate the site.

The second section is associated with the data of the declaration itself, where you must select one of the options that explain the reason for the declaration, which are mentioned below:

  • Inscription
  • Rectification or Replacement
  • Upgrade
  • Independence
  • Accumulation
  • Others
NOTE
If you select the option «Other», then you must briefly explain the reason for your affidavit.

Tax calculation data:

The third section refers to the data required to determine the tax. Where a table is presented, to enter the code and location of the property, the self-assessment (property value) and the percentage of participation or ownership that the taxpayer has with that property. Likewise, those exemption amounts and / or deductions that must be taken into account in the tax calculation are placed.

Next, to obtain the total value of the affected self-assessment, multiply the value of the self-assessment by the participation percentage, and from this result, subtract all those deductions and exemptions.

It should be noted that this procedure must be repeated with each property that is available, filling in this table. Finally, to get the tax base, it is necessary to do the algebraic summation of all the values ​​that resulted as affect self-assessment.

After that, to finally determine the value corresponding to the annual tax, a specific criterion is used. This criterion is based on the provisions of the Municipal Tax Law. Which is different for each country and even for some regions it differs.

The calculation is carried out by applying an aliquot value to the tax base according to a cumulative scale already indicated, which is deducted as follows:

  • For a self-assessment tranche of up to 15 UIT, the value of the aliquot is 0.2%.
  • When the self-assessment tranche is in the range from 15 UIT to 60 UIT, then the corresponding rate is 0.6%.
  • But if the self-assessment tranche exceeds 60 UIT onwards, an aliquot of 1% is assigned.
IMPORTANT
To complete this section, specify the number of properties declared and the amount of them that are subject to tax.

Representative details:

The fourth and last section is dedicated to the data of the legal representative of the applicant. Where the type and number of the national identity document are entered, the names and surnames, their landline or mobile reference number and a current and easily accessible email address for subsequent communications.

Now, if the affidavit is not delivered directly by the owner but will be processed by a person to whom that responsibility has been left. It is also necessary to include the data of that representative, such as their identification (first and last name), type and number of national identity document and signature and fingerprint.

What is it for?

People who are owners of a property (land, building) must complete this form, when registering, renovating, modifying or updating it. Regardless of the nature of the person (natural or legal).

Likewise, if you are the owner of the property and for some reason you cannot respond to the payment of the property tax, then you must make sure that this form is filled out by a responsible person (a possessor or holder of the property).

This person has previously been authorized to handle the procedures that concern the property and must also know all the details of the property.

It should be noted that when an owner makes a transfer of the property (sale, assignment, exchange), the payment of the tax will correspond from the moment the transfer is made until the end of that year. That is, from the year following the transfer, the responsibility for paying the property tax falls directly on the new owner.

What are the exceptions that exist to the payment of property tax?

Basically, for the payment of property tax there are some entities that are not affected by it, generally those institutions or properties that are not used to develop commercial activities for profit. Here are the most important exceptions:

  • The central or regional government, as long as they meet certain established criteria.
  • The foreign government, when the property is used for lodging or operation purposes for the service of the representatives of embassies and consulates.
  • Non-profit societies, dedicated to charity.
  • Religious entities.
  • Establishments that provide medical care and assistance services, which are public.
  • Entities where fire stations are located.
  • Higher level educational centers or basic education.
  • Forest plantations.
  • Organizations aimed at helping people with disabilities.
  • The properties occupied by union entities, previously recognized by the Ministry of Labor and Social Promotion.
  • The national monuments or cultural heritages of the country.

Service Tax Administration of Lima (SAT)
