Requirements for the Returned Migrant Certificate

Before the Ministry of Foreign Affairs and Human Mobility, the presentation of the application must contain the following documentation, in case there is no possibility of verifying the exit or entry to Ecuador, at least two (2) of the following documents will be requested:

  • Consular proceedings.
  • Consular ID.
  • Visa.
  • Certificate of registration abroad (in the case of having it).
  • Voting certificate issued abroad (if you have one).
  • Residence document.
  • Driver’s license.
  • Health card in the case of Spain.
  • Birth certificates of sons or daughters if you have them.
  • Account statements of a savings or checking account maintained abroad.
  • Passports
  • Any other document that proves their permanence abroad, in accordance with the terms established by law.

To obtain the benefits provided in the Organic Law of Human Mobility, they must meet one of the following conditions:

  • Having stayed abroad for more than two years and resumed voluntarily or forcibly.
  • Being in conditions of vulnerability qualified by the human mobility authority or the diplomatic missions or consular offices of Ecuador in accordance with the Organic Law of Human Mobility and its regulations.
  • To access the rights contemplated in this Law, the Ecuadorian person residing abroad who wishes to obtain the certification of returnee status.
  • It must not have stayed more than one hundred and eighty days, consecutive or not.

It is important to note that this Returned Migrant Certificate, It is totally optional, if for any reason it is not possible to prove the stay abroad through the documents mentioned above.

Then, the applicant may submit an affidavit in which the supporting documents that demonstrate their permanence abroad are attached.

Steps to Follow to Obtain the Returned Migrant Certificate

The procedure to obtain the Returned Migrant Certificate It is quite simple and is done in person, in consular offices, diplomatic missions or zonal coordination. The steps you must follow to obtain this document will be explained below. Take note and read carefully!

  • You must go to consular offices and diplomatic missions abroad or you can go to the zonal coordination of the place of residence or where you will carry out your economic activity.
  • You must submit the documentation already explained in the section above.
  • These must be delivered to the windows of the offices already mentioned.
  • Then, the Returned Migrant Certificate must be received.

In case of having the Provisional Certificate, it must be exchanged for the Definitive Certificate within a term of ninety (90) days, once the returned migrant enters Ecuadorian territory, at the Zonal Coordination of the Ministry of Foreign Affairs and Human Mobility , of the place where the returnee resides or exercises their economic activity.

Who is the Returned Migrant Certificate for?

The Returned Migrant Certificate, is aimed at Ecuadorian people who return to the country in order to settle in, in the case of family groups, it involves returning family members, considering the fourth degree of consanguinity and second degree of affinity.

In order to access the benefits, they must first be declared as returned Ecuadorian persons. In accordance with the legal requirements stipulated by the Organic Law of Human Mobility and its Regulations, said condition is granted through the issuance of the Returned Migrant Certificate.

This document will help the person to access the benefits, based on the rights provided in Chapter II, Section II, of the Organic Law of Human Mobility. The benefits that these people obtain are:

  • Adequate and timely social and economic inclusion.
  • Homologation.
  • Validation and recognition of studies.
  • Driving documents abroad.
  • Educational insertion.
  • Training.
  • Homologation and certification of labor competencies.
  • Access to the financial system.
  • Access to the retirement pension.
  • Exemption or reduction of tariffs for the importation of household goods.
  • Work equipment and vehicles.
  • Access to entrepreneurship programs.

Legal Bases

Article 9 of the Constitution of the Republic of Ecuador, determines that foreigners who are in Ecuadorian territory will have the same rights and duties as Ecuadorians.

In Article 40 of the Constitution of the Republic of Ecuador, it recognizes the right of people to migrate and guarantees that no human being is identified or considered illegal due to their immigration status.

Article 41 of the Constitution of the Republic of Ecuador, recognizes the rights of asylum and
refuge, in accordance with the law and international human rights instruments.

Art. 1.- Rectory of Human Mobility.- The rectory of human mobility corresponds to the Ministry of Foreign Affairs and Human Mobility, which will carry out compliance with the precepts established in the Constitution of the Republic on the matter and will exercise the powers established in the Organic Law of Human Mobility, this Regulation and other current regulations.

The Human Mobility Authority will be exercised by the person who holds the position of Vice Minister of Human Mobility, under the policy and guidelines established by the highest authority of the Ministry of Foreign Affairs and Human Mobility.

Art. 2.- Authority to declare vulnerability.- Corresponds to the person who holds the position of Vice Minister of Human Mobility or those who exercise the leadership of diplomatic missions or consular offices abroad, to give priority to situations of vulnerability.

Art. 3.- Procedure for declaration of vulnerability.- The authority, at the request of a party or when in any way it becomes aware of a situation of vulnerability, will initiate the procedure for its declaration.

Procedure started declaration of vulnerability, the person requesting or who has been identified as vulnerable, will enjoy protection and priority attention through the mechanisms.

What is the Returned Migrant Certificate?

We know that a migrant is a person who migrates, that is, who leaves the place where he or she lives and goes elsewhere to settle and build a home there. A returned migrant is any person with Ecuadorian nationality who at some point settled abroad and returns to the national territory to settle there.

This person had to have stayed abroad for more than two years and returned voluntarily or forcibly. It must be in conditions of vulnerability qualified by the human mobility authority or the diplomatic missions or consular offices of Ecuador in accordance with the Law and its regulations.

The Returned Migrant Certificate, is a document issued by the Zonal Coordination of the Ministry of Foreign Affairs and Human Mobility of the place where the returnee resides or carries out their economic activity.

The Returned Migrant Certificate declares the condition to the person of Ecuadorian nationality as well as to the family members, taking into consideration the fourth degree of consanguinity and second degree of affinity, who return to the country in order to settle in it.

Consequently, this is enabled to access the rights and benefits established in the Organic Law of Human Mobility. The benefits that the State has for returned Ecuadorians will be conceived once every fifteen (15) years. These Ecuadorian returnees may request the benefits up to twenty-four months after their return to the national territory.
