What is the Certificate of Origin?

The Certificate of origin It is a document that is issued on behalf of the Peruvian government, through which compliance with the origin requirements established in trade agreements and / or preferential regimes is attributed.

This documentation details the product to be exported. It must be stamped and signed by the exporter but also by the official who is working in the entity authorized for this.

Requirements to Request a Certificate of Origin

The Certificate of origin It must be delivered to the appropriate certifying entity, by the exporter:

  • Supporting documents on the origin of the merchandise and its materials attached with the Sworn Declaration of Origin.
  • If the Sworn Declaration of Origin is already registered, a new declaration must be created where the permanence of the information is ensured without altering it in any way. Indicating the number of the registered.
  • Signature and stamp of the exporter, in accordance with what is legally established to be reflected in the document.
  • Legible copy of export invoice or copy of bill of sale if it is a RUS exporter.
  • Proof of payment for processing rights, according to the TUPA of MINCETUR.

Issuance of the Certificate of Origin

The Certificate of origin You must demonstrate that the information contained therein, which the exporter has submitted, is adequately completed, according to the rules of origin of the commercial business or preferential regime, for which the document is being requested.

Once the review of the information has been completed, if necessary, the person conducting the evaluation will continue to sign the Certificate of Origin and stamp the corresponding seal.

The name of this person should also be included on the stamp after signing.

How to process the Certificate of Origin?

The Ministry of Foreign Trade and Tourism (MINCETUR), until now offers two ways to obtain the document. These are detailed below:
The exporter himself can directly issue a Certificate of origin, only for when the merchandise is going to enter North American markets (Canada or the United States) and Asian markets (South Korea).
Only for the United States, the importer can also process the issuance of this document.
Certification by Entities
The exporter must manage a Sworn Declaration of Origin in advance, through the Origin Component of the Single Window for Foreign Trade (VUCE).

This document must demonstrate that the merchandise being exported complies with the rules of origin established in the trade agreement.

To carry out this management, the interested party must select the commissioned entity.

The Sworn Declaration is ready, the exporter must request through the VUCE the issuance of the Certificate of origin.

Cost of Certificate of Origin

This has a cost of S / 36.00 soles adding the IGV.

To achieve the issuance of the document, the registration number of the Sworn Declaration of Origin must be presented and a digitized copy of the commercial invoices must be attached.

Issuance of the Sworn Declaration of Origin before the MINCETUR

Before the MINCETUR, all the organizations that have been authorized this function must prove the function of issuing certificates. MINCETUR has the logistics to provide the service and the technical capacity.
Its employees are instructed and evaluated from time to time to verify that they are doing the job well. Some of the agencies or institutions that issue these documents are:

  1. Exporters Association (ADEX);
  2. National Society of Industries (SNI);
  3. Lima Chamber of Commerce (CCL);
  4. Peruvian Foreign Trade Society (COMEXPERÚ).

What is it for?

The Certificate of origin works to export products from Peru.

Enjoying the tariff preferences established in the framework of signed trade agreements and / or preferential regimes granted.

It is a very effective tool to demonstrate the origin of the merchandise, that it is not triangulation products and show the direct origin from the country of origin to the destination country.

The latter has an exception. If this export conceives any reason of force majeure, be it transport or geographical issues, if the products are in danger of undergoing any modification or transformation, they must remain in customs control.

Sworn Declaration of Origin

To get the Certificate of origin, the exporter must submit together with the corresponding application, a Sworn Declaration of Origin by Product and by Trade Agreement or Preferential Regime.

This Sworn Declaration of Origin must have the signature of the exporter of the merchandise, the «Declarant”And when the case arises, the producer of the merchandise.

If the exporter is a legal entity, the Sworn Declaration of Origin must be signed by the legal representative of the company or by an authorized official.

When the same merchandise is exported by two different exporters, it is necessary to register two declarations. The Sworn Declaration of Origin must be submitted with a copy of the documents that protect it, attached.

These documents can be invoices for the materials, certificates of origin of the materials, declarations of
importation, affidavits issued by the suppliers of the materials,
among others.

What should the Sworn Declaration of Origin include?

The Sworn Declaration of Origin must include a detailed description of the production process of the merchandise to be exported. Also the consent of the producer for the visit to verify the Affidavit

The entity that verifies it must verify the information that is written in the Sworn Declaration of Origin and evaluate the origin of the merchandise, its materials and the production process under the rules of origin of the commercial agreement or preferential regime requested.

If the information presented turns out to be insufficient, the Certifying Entity will request the missing information in order to proceed with the process.

The origin of the merchandise, which may refer to the materials used or the production process carried out, may include a visit to the production plant, clearly with prior coordination with the company.

After said evaluation, the certifying entity will determine whether or not the merchandise complies with the origin requirements requested in the commercial agreement or preferential regime.

If so, the entity will register the declaration, with its respective registration date and a related numbering will be decided.

Through a letter or simple power of attorney, issued by the legal representative of the company.

Once the declaration has been registered, it can only be used by the exporter that
registered and in that certifying entity where it was registered.

The exporter may register an Affidavit of Origin for the same merchandise in more than one certifying entity, provided that there is more than one for that place of production.

If the information related to the materials or the process production shown in a Sworn Declaration of Origin has some variation (proportions, suppliers or any other), the declarant will be obliged to present a new Sworn Declaration of Origin to the certifying entity.

The first Sworn Declaration of Origin will be considered «Invalid» from the date of the new declaration, if the certifying entity discovers any modification in the production process or in the materials that intervened in it, the Declarant will be required to present a new one. Also, MINCETUR will be informed so that this organization can take the actions that correspond to the issue.

The information provided by exporters and / or producers must be treated by the certifying entity as confidential information. It can only be delivered to MINCETUR and not
may be shared with third parties.

Obtain the Certificate of Origin formats

These formats are generally established in trade agreements and / or preferential regimes and are free, except in these cases:

  1. Format used in the Generalized System of Preferences.
  2. Another format used in the Agreement with the European Free Trade Association.
  3. Non-preferential Certificate of Origin format used for the European Union.

These can be obtained in the offices authorized by the countries that grant the preferences or by the certifying entity itself as long as the exporter does not deliver said format to the entity.
